No Statewide ADU Law (Yet)
New Jersey remains a home rule state. Each of the 564 municipalities writes its own zoning ordinance. Only ~15 towns allow ADUs by-right; the majority require a D-Variance through the Zoning Board. Pending bills in the 2025–2026 legislative session (S1786/A3488) could change this — but as of May 2026 none have been signed. See "Statewide Landscape" below.

The Statewide Landscape
Home Rule Zoning
NJ's Municipal Land Use Law grants each municipality sole authority over land use. ADU rules vary dramatically from town to town — one town may allow by-right; the next requires a variance. There is no county-level ADU ordinance.
Three-Tier System
- Tier 1 (By-Right): ~15 towns. No variance hearing needed. Meet the ordinance standards and build.
- Tier 2 (Conditional): A handful of towns. ADUs allowed with restrictions (owner-occupancy, parking, board approval).
- Tier 3 (Variance Required): ~540+ towns. You need a D-Variance hearing before the Zoning Board. Uncertain outcome.
Pending Legislation
Bills S1786, A2792, and A3488 would create statewide by-right ADU status on any single-family or two-family zoned lot. As of May 2026, these bills remain in committee and have not been voted out. If enacted, Tier 3 towns would be converted to by-right status overnight.
COAH Integration (2024)
A 2024 state law now recognizes ADUs as counting toward municipal affordable housing obligations under COAH (Council on Affordable Housing). This incentivizes more towns to adopt ADU ordinances.
